RULE 52
EXPERT WITNESS
52.01 Condition Precedent to Calling Expert
Witness at Trial

(1) Where a party intends to call an expert witness
at trial, he shall serve on every other party a copy of the
expert’s signed report which shall contain, or be accompanied
by, a statement containing the expert’s name, address
and qualifications and the substance of his proposed
testimony. Service shall be made as soon as
practicable and no later than the Motions Day at which
the trial date is fixed.

(2) Where a party intends to call an expert witness
at trial but cannot obtain from him a report, or where, because
of the nature of the proposed evidence, the expert
is not required by the party to submit a written report, the
party may comply with paragraph (1) by serving on every
other party a report signed by the party or his solicitor
which sets out the name, address and qualifications of
the expert and the substance of the evidence which he is
expected to give.

(3) A party who has not complied with this subrule
shall not call an expert witness without leave of the
court.

(4) Where a report has been served under paragraph

(1) or paragraph
(2), on motion the court may order that
any records, documents or other materials on which the
report is based be produced for inspection and copying.
(5) On consent of all parties, the court may receive
in evidence at the trial a report served under paragraph

(1) without requiring the expert to attend and give oral
evidence.
52.02 Examination of Expert Witness Before Trial

(1) Where it is impractical or inconvenient for an
expert witness to attend the trial, the party intending to
call the witness may, with leave of the court or the consent
of all parties, examine that witness before the trial
for the purpose of having his evidence available for use
at the trial.

52.01 Condition préalable à la convocation d’un
témoin expert
(1) La partie qui veut appeler un expert à témoigner
au procès doit signifier à chacune des autres parties copie
du rapport de l’expert signé par lui. Ce rapport doit
indiquer ou être accompagné d’une note indiquant les
nom, adresse et compétence de l’expert ainsi que l’essentiel
du témoignage qu’il entend rendre. La signification
doit se faire aussitôt que possible et au plus tard le
jour de la séance des motions où la date du procès sera
fixée.
(2) La partie qui veut appeler un expert à témoigner
au procès, mais qui ne peut obtenir de rapport de lui ou
qui n’exige pas de lui de rapport écrit en raison de la nature
du témoignage qu’il se propose de rendre, peut se
conformer aux dispositions du paragraphe (1) en signifiant,
à chacune des autres parties, un rapport, sous sa signature
ou celle de son avocat, indiquant les nom,
adresse et compétence de l’expert ainsi que l’essentiel
du témoignage qu’il se propose de rendre.
(3) La partie qui ne s’est pas conformée au présent
article ne peut appeler un expert à témoigner qu’avec la
permission de la cour.
(4) Lorsqu’un rapport a été signifié en application
du paragraphe (1) ou du paragraphe (2), la cour peut, sur
motion, ordonner pour examen et reproduction, la production
des dossiers, documents ou autres articles sur
lesquels se fonde le rapport.
(5) La cour peut, du consentement de toutes les parties,
recevoir en preuve au procès un rapport signifié en
application du paragraphe (1), sans pour cela exiger la
comparution et l’audition de l’expert.
52.02 Interrogatoire du témoin expert avant le procès
(1) S’il est peu pratique ou inopportun pour un témoin
expert de comparaître au procès, la partie qui veut
l’appeler à témoigner peut, avec la permission de la cour
ou du consentement de toutes les parties, interroger ce
témoin avant le procès afin que son témoignage puisse
être utilisé lors du procès.

(2) Before applying under paragraph (1) to the court
for leave, the applicant shall comply with Rules 52.01(1)
or 52.01(2).
(3) Where possible, an examination under paragraph
(1) shall be conducted before the trial judge.
(4) Unless ordered otherwise or provided by this
rule, the procedure prescribed by Rule 33 shall apply to
the examination of a witness under this rule.
(5) On the examination of a witness under this rule,
he may be examined, cross-examined and reexamined in
the same manner as a witness at trial.
(6) An order for, or consent to, the examination of a
witness under this rule may provide that the examination
be recorded by videotape or other similar means either in
addition to or substitution for a typewritten transcript.
(7) Where the evidence on an examination under
paragraph (1) has been transcribed, the party whose witness
has been examined shall serve every party who attended
or was represented on the examination, with a
copy of the transcript, free of charge unless ordered otherwise.
(8) A transcript, videotape, or any other recording
of evidence taken under this Rule may, as far as it is admissible,
be tendered in evidence at the trial by a party
to the action, and such parties shall be responsible for
providing the equipment required to tender such evidence
if it is not otherwise available in the courtroom.
(9) Where the evidence of an expert witness has
been taken under this subrule, he shall not be called to
give evidence at the trial, except with leave of the trial
judge or unless the trial judge requires his attendance at
the trial.
52.03 Medical Expert
(1) Where, under Rule 52.01(1), a party has served
a report of an expert who is a medical practitioner as defined
in Rule 36.01 the report may, with leave of the
court, be admitted in evidence without proof of signature
or qualifications of the medical practitioner and without
his attendance at trial.
(2) Avant de demander la permission de la cour en
application du paragraphe (1), le requérant doit se conformer
à la règle 52.01(1) ou à la règle 52.01(2).
(3) L’interrogatoire visé au paragraphe (1) doit, si
possible, avoir lieu devant le juge du procès.
(4) Sauf ordonnance contraire ou autre disposition
de la présente règle, l’interrogatoire d’un témoin en application
de la présente règle se fait selon la procédure
prescrite à la règle 33.
(5) Le témoin entendu en application de la présente
règle peut être interrogé, contre-interrogé ou réinterrogé
de la même façon que le serait un témoin au procès.
(6) L’ordonnance d’interrogatoire ou le consentement
à l’interrogatoire d’un témoin en application de
la présente règle peut prévoir l’enregistrement de l’interrogatoire
sur bande magnétoscopique ou par un autre
moyen semblable, en plus de la transcription dactylographiée
ou en remplacement de celle-ci.
(7) Une fois la déposition recueillie en application
du paragraphe (1) transcrite, la partie dont le témoin a été
interrogé doit signifier gratuitement, sauf ordonnance
contraire, une copie de la transcription à toute partie présente
ou représentée à l’interrogatoire.
(8) Toute partie à l’action peut présenter en preuve
au procès et ce, dans las mesure où il est admissible,
l’enregistrement des dépositions recueillies en application
de la présente règle, que cet enregistrement ait été
fait par transcription, sur bande magnétoscopique ou par
tout autre moyen. Cette partie doit fournir l’équipement
nécessaire à la présentation de cette preuve si l’équipement
n’est pas disponible dans la salle d’audience.
(9) L’expert qui a fait une déposition en application
du présent article ne doit pas être appelé à témoigner au
procès, à moins que le juge du procès n’exige sa présence
ou n’en accorde la permission.
52.03 Expert en médecine
(1) Lorsqu’en application de la règle 52.01(1), une
partie a signifié le rapport d’un témoin expert ayant qualité
de médecin selon la définition de la règle 36.01, ce
rapport peut, avec la permission de la cour, être admis en
preuve sans qu’il soit nécessaire de prouver l’authenticité
de la signature ou les qualifications du médecin, et sans
qu’il soit nécessaire de le faire comparaître au procès.

(2) When an opposite party, within 10 days after
service of a report of a medical practitioner under Rule
52.01(1), serves notice in writing requiring the attendance
of the medical practitioner at trial, the report shall
not be received in evidence unless the medical practitioner
is called as a witness.
(3) Where a medical practitioner is required to attend
and give oral evidence at or before trial and the
court is of the opinion that his evidence could have been
introduced as effectively by way of a medical report, the
court may order the party who required the attendance of
the medical practitioner to pay the costs of his attendance.
