John S.Raymond Employed Costs New Brunswicker a lot?

J ohn Raymond employed with the Department of Transport testified that he is responsible for the acquisition of rights of way for highways. He gave details of the expropriation process and the attempts to conclude a settlement with Mr. and Mrs. McLeod. He explained that the Province constructed a service road which goes under the four lane highway and then went along the southern side of the highway. The underpass was a few properties away from the McLeod property. This access road could have gone onto the McLeod property and connected to the McLeod’s wood road. Mr. Raymond testified that if the service road stopped at the McLeod’s easterly property line, the McLeods could have erected a fence and a gate on their property at that point.. As mentioned earlier, Mr. McLeod did not understand this and he constructed the access road over the Delong property.

Mr. Raymond testified that the access or service road was constructed to permit equipment onto the different properties. The Province was aware of the gravel pits and lumber operations occurring on the different parcels of lands. The service road was constructed to handle the equipment used for these types of operations. The underpass could also handle this equipment. There is no plowing done on this road in winter.
